Commercial Litigation & Writs

Practice / 0101

Commercial litigation is won on preparation that happens before filing: on whether the record supports the relief you are asking for, and on whether you have asked for it in time.

We conduct commercial and civil suits, appeals, revisions and writ petitions, from institution through to execution. The work begins with an assessment of what the documents can prove, what limitation permits, and which forum gives the fastest route to the relief that matters.

What this covers

Institution and defence of suits of a specified value, including compliance with pre-institution mediation, statements of truth, and the case-management timelines that catch out parties used to ordinary civil procedure.

Injunctions, attachment before judgment, appointment of receivers and other protective orders where assets, performance or reputation are at immediate risk.

Challenges to State and instrumentality action: blacklisting, disqualification, cancellation of allotments, tender decisions and regulatory orders, including on grounds of natural justice and procedural fairness.

First and second appeals, appeals from tribunal orders, and special leave petitions before the Supreme Court of India.

Realising a decree or an award once you have it, including discovery of assets and enforcement against recalcitrant judgment debtors.
